Service Description & Scope

JetPlate is a technology platform that facilitates the ordering of prepared meals from curated restaurants and their delivery to private jet Fixed Base Operators (FBOs) and other delivery locations.

Important Disclaimer

JetPlate is NOT a restaurant, caterer, food preparation business, or logistics provider. JetPlate does not prepare, package, inspect, or deliver any meals. All food is prepared solely by the Restaurant Partner and delivered by a third-party delivery partner or the Restaurant directly.

Private Jet Catering

For private jet catering orders, meal preparation and timing are coordinated between JetPlate, the Restaurant Partner, and the FBO. JetPlate is not responsible for:

User Accounts & Eligibility

General Requirements

Alcohol Orders — Age Requirement

21+ Required for Alcohol

Orders containing alcohol products may only be accepted by individuals 21 years of age or older. A delivery driver will verify age with a valid government-issued photo ID. If age verification fails, the alcohol portion of the order will not be delivered. You will be charged for the alcohol portion if the order is declined at delivery due to failed age verification. Recipients must be present — no unattended deliveries of alcohol are permitted.

By placing an order containing alcohol, you warrant that all information provided is accurate and that the recipient is of legal drinking age. You assume all liability for false representations of age or identity.

Restaurant & Food Liability

Restaurant Sole Liability

The Restaurant Partner is solely and exclusively liable for the following:

JetPlate Disclaimer of Food Liability

JetPlate does not inspect restaurant facilities or credentials, verify food preparation methods or hygiene standards, test food for allergens or contamination, or inspect food upon pickup or before delivery.

JetPlate shall not be liable for: foodborne illness, allergic reactions, cross-contamination, inaccurate allergen information, incorrect menu item preparation, spoiled or unsafe food, or any bodily injury or illness from consuming a meal.

Allergy Warning

If you have any food allergies, you must contact the Restaurant Partner directly before ordering. Do not rely solely on JetPlate app notes or special instructions for critical allergy accommodation. Many restaurants operate in shared kitchen spaces — cross-contamination may occur even with special instructions noted. If you have severe allergies, call the restaurant ahead to confirm dedicated preparation procedures.

Delivery Partner Liability

Independent Contractor Status

All delivery is performed by independent contractors or third-party logistics providers — not JetPlate employees. JetPlate does not control the manner, method, or means of delivery; driver conduct or professionalism; vehicle choice or maintenance; route selection or timing; or food handling during transport.

JetPlate Not Liable for Delivery

JetPlate shall not be liable for: driver conduct, negligence, or misconduct; vehicle accidents or traffic violations; theft, loss, or damage during delivery; late delivery (except where specifically guaranteed); damaged or spilled food during transport; or delivery to wrong address if the customer provided incorrect information.

Each driver carries personal liability insurance. For claims arising from driver negligence, contact the driver's insurance carrier. JetPlate makes no representation regarding driver insurance coverage.

Private Jet FBO Delivery Specifics

JetPlate does not operate, control, or manage Fixed Base Operators. JetPlate coordinates meal delivery to FBOs on behalf of customers and restaurants only.

No Delivery Guarantees

Important — No Guaranteed Delivery Times

JetPlate does NOT guarantee on-time delivery for private jet catering. Estimated delivery times are approximations only — not binding commitments. Common delays outside JetPlate's control include aircraft arrival delays, flight cancellations, FBO access restrictions, restaurant preparation delays, and traffic or weather conditions.

Undelivered Orders & Meal Freshness

If an aircraft is delayed beyond 90 minutes from the estimated meal delivery time, the Restaurant Partner may dispose of the meal due to food safety concerns. In such cases, refund eligibility is governed by the Refund Policy in Section 7.

Flight Change Protocol

If your flight is delayed or cancelled:

  1. Notify JetPlate and the Restaurant within 30 minutes of the change
  2. The Restaurant will delay meal preparation if notification is timely
  3. If the meal is already prepared, the Restaurant may offer to hold it (up to 2 hours), dispose and issue a refund, or prepare fresh for a revised arrival time
  4. JetPlate will attempt to reroute delivery but makes no guarantee

Customer Responsibilities for FBO Orders

Alcohol at FBOs & Private Aircraft

Private aircraft are not subject to the FAA alcohol restrictions that apply to commercial flights. Restaurant Partners may include alcoholic beverages in private jet catering orders. All passengers consuming alcohol must be 21 years of age or older. Age verification occurs at the FBO at delivery. JetPlate assumes no liability for alcohol service on the aircraft or FBO policies regarding alcohol consumption. The Restaurant Partner remains solely liable for compliance with all applicable alcohol regulations.

Alcohol Delivery Compliance

California

JetPlate is a licensed third-party delivery platform for alcohol beverages in California. All alcohol delivery is subject to California Business & Professions Code Section 24200 et seq. (Alcoholic Beverage Control Laws). Each Restaurant Partner with alcohol products warrants that it holds a valid ABC license, has received Responsible Beverage Service (RBS) certification, and complies with all reporting requirements.

All drivers delivering alcohol must complete RBS certification. Drivers shall refuse delivery if the recipient appears under 30 without valid photo ID, appears visibly intoxicated, refuses to show ID, or if any other legal violation is suspected.

Accepted IDs: California or out-of-state driver's license, passport, or military ID. Not accepted: expired IDs, digital IDs, or secondary documents.

The Restaurant Partner is solely liable for ABC compliance and over-service liability. JetPlate is not liable for any alcohol-related claims or over-service injuries. Restaurant Partner indemnifies JetPlate for all ABC violations.

Nevada

In Nevada, alcohol delivery is permitted under Nevada Revised Statutes (NRS) Chapter 369. Restaurant Partners must hold a valid Nevada liquor license, comply with Clark County regulations (if applicable), complete Nevada TIPS certification (or equivalent), verify 21+ age with valid ID, and not sell to obviously intoxicated persons. The same indemnification and liability allocation as California applies.

New Jersey

NJ Permit Required

For New Jersey alcohol delivery, JetPlate requires a Third-Party Delivery Permit from the New Jersey Alcoholic Beverage Control board. JetPlate cannot operate alcohol delivery in New Jersey until this permit is obtained. The permit process takes 6–8 weeks. All NJ delivery drivers must be specifically trained on NJ alcohol regulations. Age verification (21+) is mandatory.

Payment & Refund Policy

Pricing & Fees

JetPlate itemizes all charges transparently at checkout in compliance with California AB 578:

No additional or hidden charges. All fees disclosed before checkout.

Private Jet Catering Pricing

The premium flat-rate pricing model (e.g., $145/person) includes meal selection, FBO delivery, and all applicable platform fees. Customization may be available based on jet type and destination. Details provided at booking.

Refund Policy

Undelivered orders — Full refund: If your order is not delivered within 2 hours of the estimated delivery time, you are entitled to a full refund (meal, service fee, delivery fee, and taxes). Tips are non-refundable. Processed within 3–5 business days.

Incorrect or incomplete orders — Full refund: If your order arrives with missing or incorrect items, a full refund applies for those items. If the entire order is incorrect, a full refund applies. Processed within 3–5 business days.

Damaged or cold delivery — Partial refund: Photo documentation required. Refund of 25%–100% at JetPlate's discretion, processed within 3–5 business days.

Refund Fraud Policy

JetPlate tracks refund request patterns. Accounts with 5 or more refund requests within 30 days may be investigated and restricted or deactivated. All refunds are returned to the original payment method — no store credit is issued.

Dispute Resolution & Arbitration

Binding Arbitration — Please Read

Any and all disputes, claims, or causes of action arising from or relating to these Terms, your use of JetPlate, or the services will be resolved by binding arbitration on an individual basis. By using JetPlate, you waive your right to jury trial, class action participation, and appeal except as permitted by arbitration rules.

Arbitration Rules

Small Claims Exception

Disputes under $500 may be brought in small claims court at the customer's election. JetPlate agrees not to pursue arbitration if you bring a qualifying claim in small claims court.

Limitation of Liability

JetPlate's maximum total liability for any claim shall not exceed the lesser of: (a) the total amount you paid for the specific order in question, or (b) $250. This cap applies regardless of the nature of the claim (contract, tort, negligence, or otherwise).

JetPlate is not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data loss, business interruption, or emotional distress — even if advised of the possibility. Refunds are the exclusive remedy for any service failure.

Liability cannot be excluded for gross negligence, willful misconduct, fraud, or violations of California consumer protection laws where exclusions are prohibited by law.

User Conduct & Account Termination

Users are strictly prohibited from:

Account Termination

JetPlate may suspend or terminate your account immediately and without prior notice if you engage in prohibited conduct, pose a risk to customer or restaurant safety, are flagged for repeated refund fraud, violate applicable alcohol delivery laws, have a payment method that fails with an unpaid outstanding balance, or otherwise violate these Terms.

Upon termination: your account is deactivated, you forfeit any unused credits or balances, you remain liable for outstanding charges, and all liability and indemnification provisions survive.

You may appeal a termination by contacting support@jetplate.app within 30 days. JetPlate will provide a written decision within 10 business days.

Privacy & Data Protection

Data We Collect

JetPlate collects name, email, phone number, delivery address, payment method information, order history, device and browser information, IP address, and location data for the purpose of processing orders, preventing fraud, improving the service, marketing, and compliance with legal obligations.

California residents have the right to know what personal data is collected, the right to delete their data, the right to opt out of the sale or sharing of their data, and the right to non-discrimination for exercising privacy rights.

Force Majeure

JetPlate and Restaurant Partners are not liable for failure to perform due to events beyond reasonable control, including natural disasters, pandemics, war or government action, labor strikes, power or internet outages, supplier failures, aviation emergencies, airport closures, public health restrictions, or any other unforeseen event preventing service delivery.

In force majeure events, JetPlate and Restaurants may suspend services without liability. Customers may request a refund or credit for undelivered meals. For private jet catering, force majeure includes aircraft mechanical failures, runway closures, weather events preventing flight operations, and air traffic control restrictions. Customers assume the risk that flights may be cancelled due to force majeure — meal refunds are available if the flight is cancelled before the meal is prepared.

Intellectual Property

JetPlate owns all trademarks, logos, designs, and branding associated with the platform. Users may not reproduce, modify, or distribute JetPlate branding; use JetPlate trademarks in advertising without written permission; reverse-engineer or copy the JetPlate platform; or scrape or harvest data from JetPlate.

By listing on JetPlate, Restaurant Partners grant JetPlate a limited, non-exclusive license to use the restaurant name, branding, menu items and descriptions, photos, and ratings for the purpose of promoting the restaurant on the JetPlate platform. Restaurants may revoke this license at any time with written notice.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any proceeding or arbitration arising from these Terms shall be brought in California state or federal court (if not subject to arbitration). You irrevocably consent to personal jurisdiction in California courts. If arbitration is required under Section 8, arbitration shall be conducted by JAMS or AAA in California, or by remote proceedings if agreed.

Amendments & Severability

Updates to These Terms

JetPlate may update these Terms at any time by posting the revised version on this page. Changes take effect immediately upon posting. Continued use of JetPlate after any amendment constitutes your acceptance of the new Terms. If you do not accept an amendment, you must stop using JetPlate and delete your account.

For major changes affecting core liability, pricing, or arbitration terms, JetPlate will provide at least 30 days' advance notice via email before the change takes effect.

Survival

The following provisions survive termination of these Terms: limitation of liability, indemnification clauses, arbitration and dispute resolution, intellectual property restrictions, privacy and confidentiality obligations, and restaurant and alcohol compliance terms.

Severability

If any provision of these Terms is found unenforceable by a court or arbitrator, that provision is severed, and the remaining Terms continue in full force and effect.
